Wager AI primarily acts as a data processor on behalf of its Customers, who act as data controllers in relation to their end users and player data.By accessing or using our Services, you agree to the terms outlined in this Privacy Policy.

Information We Collect

1.1 Customer Information

We collect information provided directly by Customers when they create or manage an account, enter into an Order Form, or communicate with us. This may include:

• Business name and contact details (email, phone, address)

• Billing and payment information

• Account credentials for authorized users

• Communications or support inquiries

1.2 Usage Data

We automatically collect information about how Customers and authorized users access and use the Services, including:

• Log data such as IP address, browser type, operating system, and access times

• Actions taken within the platform (e.g., logins, campaigns created, integrations used)

• Performance and diagnostic information used to maintain and improve system reliability

1.3 Customer Data

Customers may upload or transmit data through the Services (“Customer Data”), which may include player activity, engagement metrics, and campaign results. Wager AI processes Customer Data solely to provide the Services and does not use such data for independent purposes unless aggregated and anonymized.

How We Use Your Information

Wager AI uses information to:

• Provide, operate, and maintain the Services

• Authenticate users and manage accounts

• Process transactions and send administrative notices

• Monitor performance, troubleshoot issues, and enhance security

• Develop new features, analytics, and AI models

• Comply with legal obligations and enforce our Terms of Service

We do not sell Customer or end-user personal data.

Data Processing & AI Usage

Wager AI acts as a data processor for all Customer Data processed through the Services.

• The Customer acts as the data controller, determining the purpose and means of processing.

• Wager AI processes Customer Data only according to written instructions, as described in this Policy and the applicable Data Processing Addendum (DPA).

• Wager AI implements technical and organizational measures to protect Customer Data against accidental or unlawful destruction, loss, alteration, or unauthorized access.

  
  

Legal Basis for Processing (EEA, UK, and Switzerland)

Where applicable under the GDPR and related laws, Wager AI relies on the following legal bases for processing:

• Contractual necessity: to provide the Services under our agreement with the Customer.

• Legitimate interests: to ensure service reliability, improve functionality, and prevent abuse.

• Legal obligations: to comply with accounting, taxation, and regulatory requirements.

Sharing of Information

We do not share or disclose personal information except as described below:

• Service Providers and Subprocessors: We engage trusted third parties to support operations such as hosting, infrastructure, and analytics. Each subprocessor is bound by written agreements that include data protection obligations.

• Legal Requirements: We may disclose information if required by law, subpoena, or court order.

• Corporate Transactions: In the event of a merger, acquisition, or sale of assets, Customer information may be transferred subject to this Policy’s protections.

A current list of subprocessors is available upon request.

Data Retention

We retain Customer Data for as long as necessary to fulfill the purposes described in this Policy and the Customer’s active subscription. Upon termination or written request, Customer Data is deleted or returned within a reasonable period unless retention is required by law or for legitimate business purposes (e.g., dispute resolution, auditing).

Data Security

Wager AI maintains strict administrative, physical, and technical safeguards designed to protect the confidentiality, integrity, and availability of Customer Data.

• Data is encrypted in transit (TLS 1.2+) and at rest (AES-256 or equivalent).

• Access is restricted through role-based controls and multi-factor authentication.

• Systems are continuously monitored for unauthorized access or anomalies.

• Vulnerability assessments and penetration tests are conducted periodically.

• Security incidents are promptly investigated, and Customers are notified within seventy-two (72) hours of confirmation of any breach involving their data.

Security measures evolve over time but will not materially reduce the overall protection of Customer Data during an active term.

International Data Transfers

Wager AI is headquartered in the United States and may transfer data to other countries where it or its subprocessors operate. All transfers are performed in compliance with applicable data protection laws, using mechanisms such as the EU Standard Contractual Clauses or other legally approved safeguards.

Customer and End-User Rights

Customers and their end users (where applicable) may have certain rights under data protection laws, including the right to:

• Access, correct, or delete personal information

• Object to or restrict certain processing

• Request data portability

• Withdraw consent where processing is based on consent

Requests to exercise these rights should be directed to the applicable Customer (the data controller). Wager AI will assist Customers as required by law in fulfilling such requests.

Third-Party Services

Our Services may contain links or integrations with third-party tools (e.g., scheduling, payment processors). These platforms have their own privacy practices, and we’re not responsible for their content or handling of data.

Cookies and Tracking Technologies

Wager AI uses cookies and similar technologies to:

• Authenticate users

• Maintain session continuity

• Analyze usage patterns and improve platform performance

Customers can control cookie preferences through their browser settings.

Children’s Privacy

The Services are intended for enterprise use and are not directed toward individuals under 18 years of age. Wager AI does not knowingly collect or process personal data from minors.
